Pacely Terms of Service

These Terms define the rules for using Pacely, including browsing running events, using calculators and managing an organizer account.

This English version is provided for convenience. In case of discrepancies between language versions, the Polish version shall prevail.

1. Definitions

  • Service — the Pacely internet platform available at https://pacely.pl.
  • Service Provider — Arkadiusz Konopka Aaron, ul. Stażystów 39a/62, 43-300 Bielsko-Biała, Poland, NIP: 9372715355.
  • User — any person using the Service, including visitors browsing public Pacely pages.
  • Organizer — a user with an organizer account who adds, edits or claims events in the Service.
  • Event — information about a running race or another sports event presented in the Service.

2. Nature of the Service

Pacely is an informational and technology platform. The Service helps users discover events, compare basic information, use training calculators and navigate to external registration pages.

Pacely is not the organizer of events published in the Service unless explicitly stated otherwise for a specific event.

3. Event information

  • Event information may come from Organizers, publicly available sources or materials prepared by Pacely.
  • The Organizer is responsible for the truthfulness, accuracy and completeness of data related to their event, including dates, location, route, distances, logistics, images, event rules and registration links.
  • Pacely is not responsible for event delivery, registrations, entry fees, participant limits, event cancellation, route changes, participant safety or organizer decisions.
  • Before registering for an event, the user should verify the most important information on the official organizer website or in the rules of that event.

4. Organizer accounts

  • Selected Service features require creating and logging into an organizer account.
  • An Organizer may manage their profile, create events, edit events assigned to their account and upload materials such as images, logo, logistics information, FAQ or GPX files.
  • It is forbidden to publish illegal, misleading or harmful content, content infringing third-party rights, malware or content contrary to good practices.
  • The Service Provider may remove or limit the visibility of content, an event or an account if it violates the Terms, law, Service security or legitimate user interests.

5. Organizer content and materials

  • The Organizer represents that they have the rights or appropriate permissions to publish content and files in the Service, including images, descriptions, logos, maps, route data and GPX files.
  • By adding materials to the Service, the Organizer grants the Service Provider a non-exclusive, free-of-charge license to use those materials to the extent necessary to operate, present, technically secure and promote the Service and events published in Pacely.
  • The license includes in particular storing, technically reproducing, publicly displaying and making the materials available in the Service, creating thumbnails and presenting the materials on event pages, event lists and other places within the Service.
  • The Organizer retains rights to their materials. Removing materials from the Service does not affect technical, backup or archival copies stored for a period justified by security, accountability or protection of claims.

6. Claiming events

If an event was added to Pacely before the Organizer created an account, the Organizer may request that the event be assigned to their account. The Service Provider may require information confirming the Organizer's connection with the event.

7. Rules of use

  • The Service must be used in accordance with law, these Terms and the intended purpose of the Service.
  • It is forbidden to disrupt the Service, bypass security measures, overload infrastructure, automatically scrape data without the Service Provider's consent or attempt unauthorized access to accounts, data or systems.
  • It is forbidden to mass copy, download, store, scrape or use Service data to create competing databases, event directories or similar services without the Service Provider's prior consent.
  • Users should not submit content through forms if disclosing that content would violate third-party rights or applicable law.

8. External links and tools

The Service may contain links to external websites, including registration pages, maps, organizer websites and external event materials. Pacely is not responsible for the content, availability, security or rules of external websites.

Calculators and editorial content in the Service are informational and supportive only. They do not constitute medical, coaching or individualized race advice.

9. Availability and Service changes

The Service Provider makes efforts to keep the Service operating correctly but does not guarantee uninterrupted availability of all features. The Service may be temporarily unavailable for technical, maintenance or external reasons.

The Service Provider may develop, change, limit or remove Service features where justified by product development, security, data quality or user needs.

10. Liability

  • The Service Provider is responsible for providing the Service in accordance with applicable law.
  • To the extent permitted by law, the Service Provider is not responsible for decisions made by users based on information published in the Service where such information comes from Organizers or external sources.
  • Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory provisions of law.

11. Account deletion

An Organizer may ask the Service Provider to delete their account. Account deletion may require prior clarification of the status of assigned events, reports or data necessary to ensure Service security and accountability.

The Service Provider may delete an account or limit account access in the event of a violation of these Terms, applicable law, Service security or third-party rights.

12. Service reports

Reports concerning the operation of the Service, organizer account, event data issues or these Terms may be sent by e-mail to: arekcommerce@gmail.com. The Service Provider responds to reports within a reasonable time, no later than 14 days after receiving them.

13. Governing law

These Terms and the use of the Service are governed by Polish law. This provision does not limit consumer protection resulting from mandatory provisions of law.

15. Changes to the Terms

These Terms may be changed in particular due to Service development, feature changes, changes in law or the need to clarify the rules of using Pacely. The current version of the Terms is published in the Service.
